Infraction Deferral

WHITLEY COUNTY PROSECUTOR'S OFFICE

Our Infraction Deferral program is for speeding citations only, up to 20 mph over the speed

limit. You are allowed to have up to four points on your driving record. If you are under the age

of 18 years old or have a CDL drivers license, you are not eligible for the deferral.

Our deferral program is a six month program and is $192.50 in cost, this amount includes the

ticket and the deferral. (Do not pay both. If you pay the ticket, a judgement will be entered

and you will not be eligible for the deferral program.)

As long as you have no moving violations within the six months your ticket will be dismissed.

You are only eligible for the deferral one time within the six months.

You have thirty (30) days from the date of the offense to pay the ticket. The date on

your ticket is not a court date.
